At Stoltz Hendrickson we believe in and practice child-inclusive mediation. This does not mean that your children will actively participate in the mediation process. However, mediation of child-related topics will require that particular attention be given to the needs of your children both during and after the divorce process. Parental agreements that recognize and prioritize the needs of their children can help those children adjust to the family change and be predictive of better short and long-term outcomes for your children. When it appears that your family would benefit from additional expertise in this area, we may recommend involving additional professionals to help you reach agreements in the best interests of your children.

Mediation does not require you to have individual representation, however, if you have an attorney or feel you need one, we encourage you to include them.  Since mediators cannot give legal advice, if a party is seeking guidance specific to their legal questions or position, they will need to retain counsel to get that information.

Currently there is not limitation on who can be a mediator in Wisconsin.  Although there are model mediator guidelines, the training and experience requirements are minimal. Thus, nearly anyone can offer mediation services.

In Wisconsin, most mediators are either trained as attorneys or mental health professionals, such as psychologists or clinical social workers. Differences in approaches vary as much by professional training as by personality. But generally, the differences will be that lawyer mediators will be more familiar with court forms and the legal process itself.
